If you are going through family separation, you may need to decide the parenting arrangements for your child. We believe that every child has the right to family arrangements that promote their time with both parents, where it is safe to do so.

Every family is different, so the parenting arrangements that work best for one family will be different from another.

If you agree on arrangements, we can help you make a parenting plan or to formalise your agreement by applying for consent orders.

Where you are unable to agree, the Family Law Act 1975 (Cth) gives the Court power to make orders for the care and welfare of children in Australia. Like the Court when making any Orders, when we are giving you advice about parenting arrangements, we look at what is in the child’s best interests, including what arrangements would promote the safety of the child, views expressed by the child and the developmental, psychological, emotional and cultural needs of the child. We follow pre-action procedures, and find that more often than not, we are able to resolve parenting disputes with Solicitor assisted mediation. Commencing court proceedings is always a last, but sometimes necessary resort.
