  • How long do I have to make a workers compensation claim?

    Workers compensation claims in NSW should generally be lodged within six months of the injury or accident. However, the sooner you make a claim, the smoother the process will be. Delays can affect your ability to access compensation, so it’s always best to act quickly.


    The same time limits apply to both physical and psychological injuries.

  • Can I make a workers compensation claim after six months?

    There are some exceptions that allow a claim to be made outside the standard six-month period. These include:


    • Delayed awareness of injury – In some cases, a worker may not immediately realise they have suffered an injury or may only later discover its work-related cause. For example, hearing loss from prolonged exposure to workplace noise may not be noticeable until years later. A claim can still be made within six months of becoming aware of the injury and its connection to work.
    • Reasonable cause for delay – If a worker can demonstrate a valid reason for not making a claim within six months, they may still be able to lodge a claim up to three years after the injury. This could include ignorance of rights, a genuine mistake, or being outside NSW at the time of injury.
    • Severe injury or death – If the claim relates to an injury that caused permanent and serious disablement or death, a claim may still be made beyond the three-year period.
